Portage County Commissioner Tommie Jo Marsilio has filed a sex discrimination complaint against her former boss, saying county Prosecutor Victor Vigluicci fired her over political campaign material that expressed “substantially the same ideas” of men who remained employed in his office.Marsilio, an assistant prosecutor from 2007 until her dismissal in 2009, said she also received a smaller paycheck than male employees who had the same or fewer responsibilities, according to the complaint filed Monday in U.S. District Court in Akron.Marsilio declined to comment when reached late Tuesday. Vigluicci’s office was closed, and he could not be reached.The advertisement in question was for Marsilio’s run at a Portage County Municipal Court seat in 2009. She was one of four candidates and eventually lost to then-Ravenna Mayor Kevin Poland.The flier had been distributed to members of her campaign and the Republican Central Committee for feedback. The draft copy read: “The ‘Good Old Boys’ say elect Kevin Poland.’’ It also said Marsilio “is not a member of the Ravenna ‘Good Old Boys’ corruption club.’ ”The complaint says that without her permission, the proposed ad was given to her opponent and found its way to Vigluicci, who told Marsilio to cease distribution of the ad and apologize to Poland.Marsilio would not apologize and said the ad contained constitutionally protected political speech.Vigluicci fired her Sept. 18, 2009. There is a two-year statute of limitation on the issue, but because Sunday was Sept. 18 (a non-business day), Monday was the last day she could file the suit.Other male employees in the prosecutor’s office publicly made comments similar to the text in her ad, Marsilio said in her complaint, but were not disciplined or terminated. Male employees have also “engaged in actual misconduct” that they were not disciplined for, she said.In addition, Vigluicci “pays his female employees less than comparable male employees for the same or very similar work and responsibilities,” her suit says.Marsilio is seeking recovery of back pay, compensatory damages related to “humiliation, embarrassment, emotional distress and general loss of enjoyment of life,” and punitive damages due to wanton disregard for her rights.
